If they were to spy on their consumers, they would be caught pretty soon, as they have regular, independent third-party assessments for their data integrity and security services and engineering practices. It would be a massive blow to their long-standing position as one of the top leading AVs globally, and many would lose their trust in their products. I'm pretty sure Kaspersky would not risk getting caught spying, even if they would be forced by the Russian government. Switzerland is one of the strictest countries in the world when it comes to data privacy. Kaspersky moved most of their data processing infrastructure from Russia to Switzerland in 2018, to their new center.

Both are really good, if not equal in some regards. Kaspersky is one of the most trustworthy AVs currently, and there's a good alternative to it if you fear using it: Bitdefender. This fearmongering about Russia is entirely valid considering the current conflict, but let's not spread misinformation. At some point, the users will discover if they've been spied on. While it's true that Putin may want to spy on the West, I doubt he could force the company to spy on its users. The subreddit's been plagued for some time now with certain users that say it's not a trustworthy antivirus anymore because 'Putin can force the creators to spy on the West'.
